Terms and Conditions

  1. The Terms and Conditions set forth herein apply to all sales and purchases through Sandhills Auction Service, LLC (S.A.S.) website marketing service.

  2. In order to place a bid or make an offer, each bidder must be properly registered with Sandhills Auction Service, LLC. Bidding privileges are available only to persons who can enter into legally binding contracts under applicable law. Sandhills Auction Reserves the right to refuse services to any party at any time, if deemed necessary by S.A.S. or its representatives.

  3. All transactions will require a $35 per head down payment, due and payable to S.A.S. upon notification of the sellers’ acceptance of the bid offered.

  4. If the "Lock-in" Price is met at any time that lot will be considered "SOLD". If the "Lock-in" Price is bid, it is not retractable, and all bids are on a "First Come First Serve Basis."

  5. Payment for livestock: Payment of the total Base Price stated on the Livestock Purchase Agreement shall be paid to the Sandhills Auction Service, LLC Custodial Account For Shippers Proceeds. S.A.S. must receive the funds two days prior to the delivery date stated on the contract.

    If the actual weight of the livestock exceeds the Base weight stated on the Purchase Contract, the buyer must make final settlement on the day after the buyer receives the livestock. Payment shall be made by wire transfer or overnight delivery via Fed Ex, UPS etc. Any costs incurred for wiring funds or postage costs shall be the responsibility of the buyer.

    If the actual weight on the delivery date is less than the base weight Sandhills Auction Service, LLC will credit the buyer the funds due within 2 business days.

  6. Unless otherwise agreed, all livestock will be sold on a sliding scale on the weight that exceeds the Base Weight, with a ten pound margin.

    For Example: A load of calves with a 500 pound average Base weight sells for $100 cwt. with a 5 cent slide. On delivery day the calves average 525 pounds. There would be no adjustment up to 510 pounds (Ten pound margin), but there would be an adjustment of 5 cents for every pound thereafter.

    15 pounds over X 5 cents = 75 cents

    $100 – 75 cents = $99.25 cwt.

  7. All livestock will be weighed on a certified scale.

  8. All livestock listings are sold FOB Buyers trucks. All shipping costs will be an expense of the buyer. There will be no freight adjustments for any reason.

  9. By submitting a bid on S.A.S. website, the bidder accepts the Terms and Conditions stated both herein and on the purchase contract. If bidders are not financially prepared to place a bid on S.A.S. website, please "Do Not Bid."

  10. In the event the contracts are executed by facsimile signatures, they will be binding and enforceable as if they were in their original form.

  11. Any veterinarian, health or brand inspections before delivery shall be done at the sellers’ expense, although the buyers do have the option to have the livestock inspected by a veterinarian of the buyers’ choice at the expense of the buyer. All livestock marketed through S.A.S. are purchased subject to state and federal inspection.

  12. All information advertised by Sandhills Auction Service, LLC has been obtained from sources deemed reliable. Sandhills Auction Service, LLC make no guarantees as to its accuracy and accepts no liability for any errors and omissions. In no event shall S.A.S. be liable for lost profits or incidental damages in connection with any sale made through this web-site. All warranties expressed or implied are between buyer and seller. All prospective buyers are urged to inspect the livestock and rely on their own conclusions. S.A.S. reserves the right to remove a listing at any time for any reason without notice, and have no liability to buyers or sellers as a result of any removal of the listing. The sellers and S.A.S. reserve the right to refuse any and all offers submitted on their listings.
